A month after a grand jury decided not to indict former Ferguson police officer Darren Wilson in the killing of Michael Brown, St. Louis Prosecuting Attorney Robert McCulloch admits some witnesses lied under oath. On Friday, McCulloch gave his first interview since the trial with local radio station KTRS 550, where he discussed the case. McCulloch revealed early on in the case, he decided to allow anyone claiming to witness the Aug. 9 shooting death of Brown be presented to the grand jury and doesn’t plan on seeking perjury charges against those who lied.

I thought it was much more important to present the entire picture and say listen, this is what this witness says he saw — even though there was a building between where the witness says he was and where the events occurred, so they couldn’t have seen that. Or the physical evidence didn’t support what the witness was saying. And it went both directions. I thought it was much more important that the grand jury hear everything, what people have to say — and they’re in a perfect position to assess the credibility, which is what juries do.

Wait a second, you KNOW some lied about what they’ve seen and you STILL call them to the grand jury??? McCulloch’s revelations comes after The Smoking Gun exposed a key witness in the case who alleged she saw the moments leading up to Wilson shooting Brown. Sandra McElroy also known as, “Witness 40″ in the case gave an testimony which paralleled Wilson’s account of the fatal shooting. According to the site, McElroy wasn’t near the location where Brown was killed, and was revealed to be a racist suffering from mental illness who created a Facebook page supporting Wilson. McCulloch never names McElroy but does speak about being aware her testimony was fabricated. McCulloch stated:

This was a lady who clearly wasn’t present when this occurred. She recounted a story right out of the newspaper.
